§ 1 Introductory Provisions

This document outlines the policies and procedures regarding the collection, use, and disclosure of Customer information when using the Service. It also describes privacy rights and how the law protects the Customer.

 

§ 2 Definitions and Interpretations

  • Consumer – A person entering into a contract with the Service Provider for purposes not directly related to their business or professional activity. This includes individuals accessing or using the Service on behalf of a company or other legal entity.

  • Service Provider – Any natural or legal person processing data on behalf of the Company, including third-party companies or individuals facilitating or analyzing the Service.

  • Website – Yacht/Boat Registration in Poland – The best offer

  • Company – Yacht/Boat Registration in Poland,  Joanna Kwolek, ul. Czernicka 4/12, 51-315 Wroclaw, Poland.

  • Terms and Conditions – These regulations.

  • Usage Data – Data collected automatically, including the duration of a page visit and other Service-related information.

  • Request – A Customer’s declaration of intent submitted via the Contact Form to conclude a Product.

  • Service – Services available on the Website, forming the basis of the contact between the Customer and the Service Provider.

  • Cookies – Small files stored on a Consumer’s device containing browsing history details.

Customers may communicate with the Service Provider using the provided contact details. Phone communication is available between 9:00–17:00.

 

§ 4 Technical Requirements

To use the Website, the following are required: a. A device with internet access and a web browser b. An active email account c. Enabled Cookies

 

§ 5 General Information

  • The Service Provider is not liable for disruptions caused by force majeure, unauthorized third-party actions, or incompatibility with the Customer’s technical infrastructure.

  • Prices listed on the Website are in Euros (EUR) and include VAT.

  • The final amount payable includes all costs, including service fees, delivery, and sworn translations.

 

§ 6 Delivery and Payment Methods

  • Delivery is available worldwide.

  • Accepted payment methods:

    • Bank transfer

    • Visa / Visa Electron

    • Mastercard / Mastercard Electronic

    • Maestro

§ 7 Documentation Required for Yacht Registration

The Registration Office may require original documents before issuing the final Registration Certificate. Customers must send documents via mail or courier at their own expense. After verification, the documents will be returned along with the Registration Certificate.

Required documents include:

  • Proof of ownership (purchase and sale agreement, invoice, bill of sale, or notary statement)

  • De-registration document (if not the first registration)

  • Copy of ID/passport or company formation document (if owned by a company)

  • Engine documents (mandatory for engines over 20 HP)

  • CE Certificate or Class Certificate (required if the yacht is less than 10 years old, manufactured outside the EU, or never registered in the EU)

  • Measurement document (for vessels over 15 meters, e.g., builder’s certificate, tonnage certificate, survey report, or yacht manual)

  • Photo of the vessel identification number (HIN/VIN/CIN/INI) – required only if the hull number complies with Registration Office criteria.

If the hull number does not meet the criteria, a Polish identification number will be assigned in the format: YY-xxx@@@@@X999. Customers may optionally order an Extract Document to confirm the actual hull number.

 

§ 8 Documentation Required for MMSI Radio License

  • Copy of CE Declaration of Conformity for all radios listed in the application form

  • Copy of the Polish Registration Certificate

  • Copy of a valid personal radio operator license (issued by a government institution; other certificates are not accepted)

  • Completed application form for a ship radio license (in capital letters)

  • Signed power of attorney (in capital letters)

If the Consumer does not hold a government-issued certificate, the Service Provider recommends considering an exam arranged by the Royal Yachting Association, available in various countries.

 

§ 9 Documentation Required for Commercial Yacht Registration

To register a yacht as commercial, it must pass a technical inspection and obtain a Certificate of Sailing Capacity (issued by the Polish Sailing Association).

  • Consumers must cover the cost of inspection and travel.

  • For an additional fee (€250), the Service Provider can arrange for an inspector to visit the yacht’s location.

  • The Service Provider can also prepare a list of required safety equipment and supporting documentation.

  • The cost of the survey depends on the yacht’s specifications (size, engines, etc.) as stated in the CE Certificate.

  • An MMSI Radio License is also mandatory.

 

§ 10 Collection and Use of Consumer Data

Data collected:

  • Usage Data (IP address, browser type, time spent on pages)

  • Tracking Technologies (Cookies, Flash Cookies, Web Beacons)

  • Personal Data (name, email, phone number, address, payment details)

Purpose of data collection:

  • Performance of the Service

  • Contacting the Customer

  • Managing Customer requests

  • Business transfers

  • Analysis and marketing

Data recipients:

  • Polish Registration Office (portal.reja24.gov.pl)

  • Shipping carriers

  • Online payment providers

Customer rights:

  • Access and correction of data

  • Data provision is voluntary but necessary for service completion

 

§ 11 Complaints

Consumers may request corrections if a service has defects. If the Service Provider fails to remedy the defects within a reasonable time, the Consumer may withdraw from the contract.

Complaints will be processed within 14 days of receipt and should be sent to contact@yacht-registration-poland.com

 

§ 12 Withdrawal from the Contract

Customers may withdraw from the contract within 14 days without providing a reason. Costs incurred for certified translation services are non-refundable.

 

§ 13 Refunds

Refunds for transactions made via payment card will be processed to the bank account associated with the Customer’s payment card.
